Is it legal for an Estate Liquidation Service that is handling an estate sale to charge sales tax in Texas?
Q. We have an estate sale going on here in Littlefield, Texas. These people here are having an estate liquidation service handle the estate sale. They charge sales tax on all the merchandise sold. Saying they have to pay sales tax on their merchandise, so they are charging sales tax on the merchandise that they are selling for the people that is having the estate sale on the death of their mother. I was told by them, that they have to pay sales tax, so they charge sales tax on all estate sales that they do. Now if they don't send in the sales tax collected for this estate, but keep it in reserve for when they do have to pay their tax;s is this legal?

A. Yes, they are required by law to collect the tax and then turn it over to the state.
